Terms of Service

Effective June 12, 2026

1. Acceptance

By accessing or using Resupply you agree to these terms. If you do not agree, do not use the service. These terms form a contract between you (the customer) and Resupply.

2. The service

Resupply provides a platform for managed cold-email outreach: lead list management, website enrichment, AI-assisted email drafting, human review, and scheduled sending from your own domain. We are not an email marketing platform for bulk newsletters or promotional blasts to existing customers. The service is designed for targeted, personalized business-to-business prospecting.

3. Acceptable use

You agree not to use Resupply to:

  • Send emails that violate CAN-SPAM, CASL, GDPR, or any applicable law
  • Contact individuals who have unsubscribed or requested to stop receiving emails
  • Send misleading, deceptive, or fraudulent content
  • Impersonate another person or organization
  • Send from a domain you do not own or are not authorized to use
  • Use the service for harassment, spam, or any abusive purpose
  • Attempt to circumvent the approval queue or warmup limits

You are responsible for all content sent through your workspace, including AI-generated drafts that you approve. Approving a draft means you have reviewed it and accept responsibility for its contents.

4. Your domain and sending reputation

Resupply sends email from your actual primary domain. You are responsible for maintaining your domain's sending reputation. We implement warmup ramps and daily volume caps to protect you, but we are not liable for deliverability issues, domain blacklisting, or damage to sending reputation that results from your content, your lead quality, or your violation of these terms.

5. Your data

You retain ownership of your lead data and any content you create within the service. You grant Resupply a limited license to process that data to operate the service. We do not sell your data or use it to train AI models.

6. Payment

Subscription fees are billed monthly. Failure to pay results in service suspension. Refunds are not provided for partial months. We reserve the right to change pricing with 30 days notice.

7. Service availability

We aim for high availability but do not guarantee uptime. Scheduled maintenance, infrastructure failures, or third-party outages (email provider, AI provider, database) may cause temporary service interruptions. We are not liable for missed sends or business impact due to downtime.

8. Termination

We may suspend or terminate your account if you violate these terms, abuse the service, or engage in behavior that threatens the deliverability or reputation of the platform. You may cancel at any time from your account settings. Upon termination, your data is deleted within 30 days.

9. Limitation of liability

To the maximum extent permitted by law, Resupply is not liable for indirect, incidental, special, or consequential damages, including lost revenue, lost data, or reputational harm, arising from your use of the service. Our total liability for any claim is limited to the amount you paid us in the 3 months preceding the claim.

10. Changes

We may update these terms. Material changes will be communicated by email to the address on your account at least 14 days before they take effect. Continued use after the effective date constitutes acceptance.
